Backers said it would lower insurance rates and improve business outcomes for small trucking companies. Opponents said it would deny plaintiffs valid procedural claims.
The lawsuit alleges that the 35 linked MSG companies paid "millions of dollars in premiums," but "instead of honoring their obligations, the insurers have paid nothing for the MSG Insureds' losses."
Massachusetts law states "the unambiguous terms of an insurance policy must be strictly enforced and an insured's failure to comply with the notice provision of a claims made policy bars coverage."
