On July 25, 2006, Willis Duncan alleged that he tripped over abox of motor oil in the automotive aisle at a Magic Mart located inPike County, Ky. Following the incident, Duncan claimed he sufferedan injury to his knee and emotional suffering, includingembarrassment. Investigation into the case, however, revealed thatDuncan had in fact injured his knee while at work for Jacob Miningfour days prior to the Magic Mart incident. Authorities evenobtained an in-store surveillance video with footage that capturedDuncan limping prior to his alleged fall.

After review of the video, the court ordered Duncan to submit toa discovery deposition. Duncan's testimony provided severalinconsistencies with both the record and surveillance tape,including his story that he had not seen the box before the allegedfall. The surveillance video proved his testimony false, as itshows Duncan and his wife in the aisle before his fall, where heappears to be looking at the box. He also testified that he hadlost wages because of the mishap at the store, when in reality hewas receiving payment from Jacob Mining for the work-related kneeinjury.

On April 22, 2010, Duncan was arrested and charged with onecount of fraudulent insurance acts over $300. He stood before thePike County District Judge where he entered a guilty plea to thecharge and was sentenced to 12 months, which was probated for 24months. He was also ordered to pay court costs in the amount of$150.50 and investigative expenses in the amount of $1,000 to theFraud Investigation Division. All fines and court costs were paid,but probably left Duncan hurting and a little more embarrassed thana real fall would have.
