Calif. State Fund Subject To RBC Regulations Court sides with insurance department on oversight authority; no word on appeal
In a key ruling last week, a judge found that the California Department of Insurance has authority over the State Compensation Insurance Fund under the states risk-based capital statute.
The decision by Superior Court Judge Paul Alvarado in San Francisco came as the result of a lawsuit filed by SCIF against the department in May 2003, contending among other things that it was not subject to the states RBC laws.
