A $3M southeastern soil remediation/scrap metal recyclerspecializes in remediating and transporting contaminated soil,treating/burning the contaminants, and selling the treated soil toconstruction companies for reuse. They also remove undergroundstorage tanks and recycle the steel once it is properly remediatedand treated.

The insured currently has a package GeneralLiability/Contractors Pollution policy, but the ContractorsPollution is limited to jobsite coverage only. Additionally,hauling the soil back to their owned processing center is notcovered, and their General Liability policy does not includeProducts Pollution coverage for the reselling/reuse of the soilintended as infill dirt for other projects. By carefully reviewingthe current insurance program and identifying the areas stillneeding coverage, we have helped the agent rework the account sothat the client now has sufficient protection in the event of aclaim when handling, transporting, storing, or distributing thesoil. The new policy(s) will include General Liability/ContractorsPollution Liability, Transportation Pollution Liability, ProductsPollution, and Site Pollution. In addition, the insured will securea $4 million Excess policy and Auto coverage with BroadenedPollution endorsement and MCS90.

The premium breakdown totals:

  • $15k in premium with a $1M limit for the General Liability,Products Pollution, Contractors Pollution Liability, and SitePollution.
  • $17k in premium for a $4M Excess policy over theprimary.
  • $36k in premium for the Auto coverage, which includes BroadenedPollution and MCS90.

This is a great example of why is it important toexamine your clients' policies to make sure ALL of their operationsare covered. The coverage written in prior years may nothave been carried out correctly, or the extent of the insured'sdaily activities may not have been fully explored or understood.Reviewing an existing policy may bring to light some gaps incoverage—and provide an opportunity for the agent to add additionallines to a policy.
