With the economy continuing to crumble, litigation in the workplace and elsewhere is expected to ramp up as plaintiffs try to make themselves financially whole by tapping into the insurance industry's deep pockets. The appetite for both ordinary and class-action lawsuits keeps growing.
But the insurance industry, overall, hasn't done the best job in managing litigation and working efficiently with outside defense law firms. It's one of the biggest issues facing insurers, which spend an enormous amount on outside counsel–tens of billions of dollars annually.
Lack of industry standards is one of the biggest problems. Each insurer has its own set of rules for its defense firms. If you're a defense lawyer representing different insurers, it's confusing and inefficient to follow multiple sets of rules. And it's equally inefficient for insurers to communicate and continually reinforce their guidelines with their defense lawyers across the country.
