New travel insurance regulations in New Jersey will take effect April 18, changing how travel insurance is sold in the state.

Anyone selling, soliciting of negotiating travel insurance in the state will now have to be a licensed producer. Travel retailers who offer travel insurance can continue doing so, but only if it's on behalf of and under the direction of a licensed travel insurance producer.

Other key components of the new regulations include:

  • No opt-out marketing: Travel insurance can't be sold using pre-checked boxes or "negative option" sales techniques.
  • Transparent marketing: For example, blanket travel insurance can no longer be marketed as free insurance coverage.
  • Written materials: Retailers will have to provide prospective purchasers with insurer-approved written materials that include the identity and contact information of the insurer. After a purchase, policyholders must receive a description of the material terms of the insurance coverage as well as information on how to file a claim and change or cancel coverage, plus contact info for both the insurer and producer.
  • Training requirements: Licenses producers must make sure all travel retailer employees have received instruction on the policies they sell.
  • Retailer register: Producers must maintain a formal register of every travel retailer that offers coverage on their behalf.
  • Premium tax: Insurers must pay taxes on premiums paid by New Jersey residents.

States are increasingly updating their travel insurance regulations. As of last year, 29 states had adopted travel insurance regulations based on the NAIC model act, which is similar to New Jersey's new legislation. Another 19 states have created their own regulations regarding travel insurance.
