New York S.B. 8708/A.11756 incorporates various proposals concerning New York's workers' compensation self-insured groups.
If enacted, the legislation will clarify the liabilities of self-insurers and procedures for making assessments, and will allow assessments to be offset by funding from a new, temporary "group self-insurer default fund" that could use funds from the state's uninsured employer funds.
The bill also includes:
o Higher financial penalties for employers without workers' compensation coverage
o Stronger regulation of groups by the Workers' Compensation Board
o Tighter regulation and licensing requirements for group trust administrators
o Termination of underfunded groups starting in 2015
o Clear, ongoing liability by members of self-insured groups and individual self-insured employers for defaults by other self-insurers or groups
o Creation of a new group self-insurance advisory committee
o Creation of new local occupational health clinic advisory committees
