The Nebraska Supreme Court today reversed a 2007 multi-million dollar judgment in favor of the State of Florida against former Omaha insurance agent David Fulkerson after a 10-year legal battle.

Despite the sucess, the suit has cost Fulkerson his agency and resources defending himself during the legal battle.

The 1998 Florida suit sought recovery from Fulkerson of more than $5 million in customer insurance premiums once held by Countrywide Truck Insurance Agency, which Fulkerson once managed. Until the suit forced its closing, Countrywide coordinated insurance coverage for thousands of small independent truckers across the country. Fulkerson argued that $2 million of the premium deposits were misappropriated by the company that acquired Countrywide, and the rest were returned to Countrywide's customers as required by Nebraska law.

According to the Nebraska high court, when the Florida suit went to trial in August 2006, Douglas County District Judge Peter Bataillon committed error by discharging the jury hearing the case and entering the judgment against Fulkerson himself. The high court also pointed out that persons and entities other than Fulkerson were in control of Countrywide Truck's affairs.
