Claims News Service, April 14, 1:09 p.m. EDT — The U.S. District Judge for the Southern District of Mississippi recently denied a motion by Elmer and Alexa Buente for partial summary judgment in their lawsuit against Allstate Insurance Company.

Buente v. Allstate centered on the actual cause of damage to the Buentes' home during Hurricane Katrina. The Property Casualty Insurers Association of America, the American Insurance Association and the National Association of Mutual Insurance Companies jointly filed an amicus brief in the case.

According to the three organizations, the Court held that hurricane water damage is excluded from coverage because the exclusions in the Buentes' policy were clear and unambiguous.
