A bill on its way to the Louisiana Senate floor has drawn the ire of insurance groups such as the National Association of Mutual Insurance Companies and the Property Casualty Insurers Association of America. The two associations claim that House Bill 509 will unfairly penalize the state's safe drivers and will restrict insurers from knowing whether their consumers have received tickets for certain violations.

The main provision of the bill reads: “The operating record of an individual shall not include citations for violation of any statute or ordinance requiring use of a seatbelt or wearing a motorcycle helmet.”

“Operators who ignore these safety precautions should be known to insurers, and their unsafe behaviors should be reflected in higher premiums,” said NAMIC's state affairs manager, David Reddick. “This type of legislation ends up protecting them and not the operators who use seatbelts and helmets.”

At risk for drivers are safe driver discounts and lower rates for those with clean driving records, according to the associations.
