Employment Practices Seminars Help To Prevent, Fend Off Claims

A series of employment practices liability educational seminars to be held across the country from May until July will offer guidance on how risk managers, human resource professionals, attorneys, as well as insurance agents and brokers can protect against increasingly complex employment-related exposures.

The seminars–sponsored by The National Underwriter Company (parent of this publication), the Risk and Insurance Management Society, and the Florida Workers' Compensation Institute, and co-sponsored by four leading law firms–are designed to give attendees the background knowledge and tools they'll need to help prevent employment practices claims, and defend against any such claims should they arise.

The seminars, which offer credit towards the continuing education requirement of the new RIMS Fellow designation, will take place in:

New Orleans–May 9-10.

Nashville–May 15-16.

Orlando–May 23-24.

Atlanta–June 10-11

Dallas–July 8-9.

In each session, an expert will present legal issues affecting employment practices. Participants will then break into small groups and apply their understanding of the issues by working through case studies and factual scenarios. Solutions presented by the groups will be compared to allow an exchange of ideas and to identify and develop best practices.

The topics explored at each seminar, along with the co-sponsoring law firms making each presentation, include:

The Interrelationship Between Workers' Compensation and Employment Law–presented by McConnaughhay, Duffy, Coonrod, Pope & Weaver. The discussion will focus on how to avoid high-risk workplace behaviors, as well as the claims-defense team's role in workplace risk management.

Reducing Litigation Costs–presented by Constangy, Brooks & Smith LLC. Discussions will focus on OSHA inspections, including a look at the rights of employers, along with an examination of liabilities assumed by the employer who chooses to outsource staff functions.

State-of-the-Art Practices to Minimize Litigation–presented by Baker & McKenzie. Discussions will focus on dealing with people in the workplace, with a special look at emerging exposures in the new “digital workplace.”

Investigating and Resolving Alleged Employee Misconduct–presented by Jackson, Lewis, Schnitzler & Krupman. This will include a special look at resolving sexual harassment claims against high-level executives.
