"My amici clients, who are manufacturers, are concerned about whether manufacturers will receive the tort liability insurance coverage that they paid substantial premium for and that they expected," said Sherilyn Pastor, an insurance recovery partner at McCarter & English in Newark, New Jersey, who authored the amicus brief on behalf of the Product Liability Council and the National Association of Manufacturers.

"Here, we have concluded that Wesco's contacts with Massachusetts are unrelated to the claims in this case, and that whatever indirect contact (if any) Wesco had with Massachusetts related to Pray's claims is insufficient to satisfy due process," Massachusetts Appeals Associate Justice Peter Sacks wrote for the unanimous three-judge panel.

"Under the circumstances, the court sees no alternative but to grant the motion for judgment notwithstanding the verdict. While that is not an obviously sensible result, it is required by the terms of the policy and by Massachusetts law," Chief Judge F. Dennis Saylor IV wrote.
