Ensuring the plaintiff adhered to a medical treatment plan was one of the key contributing factors in personal injury litigation.
The plaintiff, Nikita Bronitskiy, owns Putnam-based Total Building Services, a construction contracting firm, and is married and has two children
"It helped ensure a proper diagnosis of his injury which eventually led to the surgical correction of that injury, which was a success," said plaintiff counsel Ryan Veilleux of the Carter Mario Law Firm.
A lawsuit against the 33-year-old woman who crashed into Bronitskiy's red Ford Ranger on Route 44 in Pomfret settled for $160,000.
"The number essentially represented payment of the medical bills and $100,000 for pain and suffering," Veilleux said. "He was fully compensated for his losses."
On Jan. 12, 2019, Bronitskiy, who lives in Putnam, was driving home from work when Emily Colwell turned in front of him from a side street, according to a police report.
The lawsuit, which claimed negligence and carelessness on the part of Colwell, was withdrawn on Dec. 8 following the settlement.
The drivers both had motor vehicle insurance, and Colwell's carrier paid the settlement costs.
The defendant attorney, John Majewski, did not respond to a message seeking comment Friday.
Colwell's gray Nissan Versa crashed into the oncoming pickup truck, according to court documents.
Colwell, who lives on the side street, Wrights Crossing Road, was leaving her house to run errands. She told police she didn't see Bronitskiy's pickup truck heading toward her, the report says.
Bronitskiy, 32, said he didn't have time to stop, so he braced for impact, according to the report. Both drivers were wearing seatbelts. The weather was clear.
Bronitskiy needed surgery for a labral tear of his left shoulder, and suffered neck and back injuries, Veilleux said.
"He's doing pretty good," said Veilleux added. "He made a fairly good recovery, but he does have some limitations when doing overhead work."
The impact caused disabling damage to the front of both vehicles.
Bronitskiy and Colwell were taken to Day Kimball Hospital with minor injuries.
State Police gave Colwell a verbal warning for failure to yield at an intersection.
