The Texas Department of Insurance published a news release reminding insurers that they may not refuse to write or nonrenew residential property insurance based on a property's age.

Prohibited Trade Practice 28 TAC §21.1006 states that insurers cannot decline to write residential property insurance based on the age of the property or any of the property's individual components or materials. This includes the wiring, heating, air conditioning, plumbing, siding, and roofing.

Insurers may still decline to write coverage based on the physical condition of the property or any of the individual components, but not solely based on the age.
