The Maine Bureau of Insurance issued Bulletin 491 to ensure drivers are excluded from private4 passenger auto policies only in limited circumstances when certain requirements are met as follows:
1. The exclusion must be made to avoid cancellation or nonrenewal of an auto policy and to allow the insurer to continue coverage without an unreasonable risk. The exclusion must apply to a specific, named individual identified on the policy.
2. The policyholder and insurer must both agree to the exclusion.
3. The insurer must show that an excluded driver has committed an act for which the policy could be cancelled or nonrenewed under Maine Statutes.
4. The exclusion must be documented through an endorsement to the policy, clearly identifying the excluded driver and the terms of the exclusion. The endorsement must be filed and approved by the Bureau, and the insurer and insured must both sign the form. The endorsement is to contain the following notice in conspicuous print:
"NOTICE TO POLICYHOLDER IF THE PERSON EXCLUDED FROM COVERAGE BY THIS ENDORSEMENT IS UNDER THE AGE OF 18 YEARS, YOU CAN BE HELD LIABLE UNDER STATE LAW FOR THE PERSON'S NEGLIGENCE WHEN THE PERSON OPERATES YOUR VEHICLE WITH YOUR PERMISSION. YOUR POLICY DOES NOT INSURE YOU AGAINST THIS LIABILITY."
5. The insured's proof of insurance or financial responsibility must list any excluded person on the policy.
