BP 07 87 07 13 Photography – Amendment of Coverage Territory for "Photographic Equipment"
This endorsement is a coverage endorsement used to insure eligible contractor risks, based on the selected coverages shown in the endorsement schedule. The limits that apply to the coverages are in addition to the business personal property limit provided under BP 00 03. The mandatory coverage provided applies to contractors' installation coverage (Coverage 1), with an option to cover contractors' tools and equipment (Coverage 2), with sublimit options of $500, $1,000 or $2,000 for any one tool or piece of equipment, or a blanket option for all tools and equipment. If tools and equipment are individually described in the schedule, a zero must be entered in the blanket limit section. An option to value property subject to the blanket limit at actual cash value is also provided.
The endorsement schedule also allows for covering non-owned tools and equipment leased or rented from others that are in the insured's care, custody or control (other than employees' tools), described as Coverage 3. Such property is covered while away from the described premises. The coverage is restricted to non-owned tools and equipment leased only for a term of six months or less.
The 08 24 edition of this form was revised to extend exceptions to the earth movement and water exclusions, which previously applied only to Coverage 2, to apply to each coverage provided under this endorsement. This is a coverage enhancement from the prior editions.
BP 07 02 07 02 Amendment – Aggregate Limits of Insurance (Per Project)
This endorsement amends the aggregate limit of insurance for liability and medical expenses from a per policy aggregate to a per project aggregate, for every project engaged in by the insured contractor that is covered by the businessowners policy.
BP 07 03 01 06 Business Liability Coverage – Property Damage Liability Deductible (Per Claim Basis)
This endorsement applies a per each claim property damage liability deductible. A mandatory property damage deductible of $250 applies to the painting classification (applicable to interior and exterior painting less than three stories in height). For these risks, this endorsement may be used or BP 07 04, which applies the property damage deductible on a per occurrence basis.
BP 07 04 01 06 Business Liability Coverage – Property Damage Liability Deductible (Per Occurrence Basis)
A mandatory property damage deductible of $250 applies to the painting classification (applicable to interior and exterior painting less than three stories in height). This endorsement applies that deductible on a per occurrence basis. For painting risks, this endorsement may be used or BP 07 03, which applies the property damage deductible on a per claim basis.
BP 07 07 01 06 Business Liability Coverage – Amendment of Liability and Medical Expenses Limits of Insurance
This endorsement increases the aggregate limit that applies to the products/completed operations hazard to three times the liability and medical expenses limit (in lieu of two times as provided for in BP 00 03).
BP 07 08 07 13 Pesticide or Herbicide Applicator – Limited Pollution Coverage
This endorsement is applicable to landscape gardening operations. The endorsement amends the pollution exclusion to make it inapplicable to the operations of a landscape gardener, provided such operations meet all standards of any statute, ordinance, regulation or license requirement of any federal, state or local government that apply to such operations.
BP 07 10 08 24 Hotels, Motels and Inns
This endorsement is mandatory when insuring eligible hotel, motel or inn risks. The endorsement amends the business personal property provisions to specify that guests' property is not considered property of others; and adds as property of others the property in hotel, motel or inn rooms that is furnished by the respective operator. In addition, a $2,500 limit is provided for lock replacement coverage. With respect to liability coverage, the endorsement includes a specific limit for Liability For Guests' Property of $25,000, subject to a $1,000 per guest limit. Exclusions specific to these coverages are included in the endorsement.
BP 07 11 08 24 Hotels, Motels and Inns – Liability for Guests' Property in Safe Deposit Boxes
This endorsement may be used in conjunction with BP 07 10 to cover guests' property held in a safe deposit box on the insured's premises. Per occurrence limits available are $25,000, $50,000, $100,000 or $250,000 and an optional property damage liability deductible may be applied.
BP 07 12 01 10 Self-Storage Facilities
This endorsement is mandatory when insuring self-storage facility risks. The endorsement amends the property coverages to provide employee theft coverage to include personal property of the insured's customers. This coverage is limited to property that the customer owns or leases or that the customer holds for others. BP 07 12 also adds accrued rental charges to the business income coverage. This adds coverage for loss of accrued rental or lease charges for storage spaces rendered unrentable because of a covered loss.
Liability coverage is added to provide a $50,000 liability limit for customers' goods, and a $25,000 sale and disposal liability limit. Under the customers' goods legal liability section, the endorsement will pay for those sums that the insured becomes legally obligated to pay as damages because of property damage caused by an occurrence to a customer's property (or the property of others for which such customer is liable) only while the property is at the insured's self-storage facilities.
Under the lock-out or sale removal coverage, the endorsement will pay will pay those sums that the insured becomes legally obligated to pay as damages because of acts or omissions arising out of a lock-out or the sale, removal, or disposal of customers' property in the course of sale and disposal operations.
Exclusions pertinent to these coverages are added, and the pollution exclusion is amended to exclude pollutants brought onto the location by customers.
BP 07 75 07 13 Apartment Buildings
This endorsement increases the pollutant cleanup and removal limit to $25,000. A reward payment section is added to reimburse the insured up to $5,000 for rewards paid for information leading to the arrest and conviction of any persons committing a crime resulting in loss or damage to covered property or for the return of stolen covered property when caused by theft. Ordinance or law equipment coverage is also added, as well as coverage for lock replacement and tenant move-back expenses.
Loss of or damage to money, securities, or other property sustained by a tenant resulting directly from theft committed by an identified employee is covered. Only the insured can make a claim under this insurance. Coverage is provided for sums the insured becomes legally liable to pay as damages because of property damage to a tenant's property while in the insured's care, custody, or control inside the insured's leased unit, apartment, or storage at the described premises.
The endorsement provides coverage for sums the insured becomes legally obligated to pay as damages because of acts or omissions arising out of a lock-out or the sale, removal, or disposal of tenants' property in the course of sale and disposal operations. The insurer must be notified as soon as possible of a lock-out or the sale, removal, or disposal of tenants' property.
Coverage is also added for payments the insured voluntarily makes because a tenant demands remuneration of rent as a result of the complete loss of heat or air conditioning to a tenant's leased unit or apartment. The loss must be due to mechanical breakdown or electrical failure. The insured must notify the insurer as soon as possible of a demand for remuneration or of a voluntary payment.
The following definitions have been added: "lock-out," "sale and disposal operations," and "tenants' property."
BP 07 76 07 13 Apartment Buildings – Loss or Damage to Tenants' Autos (Legal Liability Coverage)
This endorsement provides coverage for the insured's legal liability for loss or damage to tenants' and invitees' autos while in the care, custody or control of the insured at the described premises. Losses are payable only for the account of the owner of the auto. Coverage applies only for the insured's legal liability for the loss or damage.
BP 07 77 08 06 Fine Arts Coverage
This endorsement provides coverage for direct loss of or damage to fine arts owned by or in the care, custody or control of the insured. This endorsement is available for eligible restaurant and apartment building risks.
BP 07 78 07 13 Restaurants
This endorsement is available when insuring eligible restaurant risks under the businessowners coverage form BP 00 03. When BP 07 78 is attached, there is no need to attach either BP 04 15 Spoilage Coverage or BP 04 31 Food Contamination endorsements. The Restaurants endorsement provides a reward payment section to reimburse the insured up to $5,000 for rewards paid for information leading to the arrest and conviction of any persons committing a crime resulting in loss or damage to covered property or for the return of stolen covered property when caused by theft. An additional coverage is added stating that the insurer may take damaged branded or labeled merchandise at an agreed or appraised value if the merchandise was damaged by a covered cause of loss. Repair or replacement of covered equipment as required by law is also covered. Up to $1,000 (with a $100 deductible) is available for the cost to repair or replace locks due to theft or other loss to keys. Loss of perishable stock caused by a change in temperature or humidity resulting from mechanical breakdown or failure of equipment at the described premises, contamination by refrigerant, or power outage is covered for up to $10,000 (or a higher limit if shown in the declarations). Coverage is provided to clean equipment, replace contaminated food, to provide medical tests of vaccinations to infected employees, loss of business income due to the necessary suspension of operations, and additional advertising expenses incurred to restore reputation if the business is ordered closed by the Board of Health due to the discovery or suspicion of food contamination.
The $3,000 limit of insurance for additional advertising expense may also be increased.
Loss of or damage to money, securities, or other property sustained by a customer resulting directly from theft committed by an identified employee is covered. Only the insured can make a claim under this insurance.
The endorsement adds the following property definitions: "food contamination," "other property," and "perishable stock."
Under the liability section, coverage is added for sums the insured becomes legally obligated to pay as damaged because of failure to deliver or a misdelivery of items by the insured, his employees, or a concessionaire trading under the insured's name. The insured must notify the insurer as soon as practicable of an error or omission that may result in a claim. Merchandise withdrawal expenses, whether the insured or an authorized government entity orders it, are also covered. The insured must notify the insurer as soon as practicable of any actual, suspected, or threatened defect in the insured's product or any governmental investigation that may result in a merchandise withdrawal.
The following liability definitions are added: "defect," "merchandise tampering," "merchandise withdrawal," and "merchandise withdrawal expenses." The definition of "products-completed operations hazard" is also replaced.
BP 07 79 07 13 Restaurants – Loss or Damage to Customers' Autos (Legal Liability Coverage)
This endorsement is only applicable to restaurant risks. BP 07 79 provides legal liability coverage for loss or damage to customers' and invitees' autos while in the care, custody or control of the insured at the described premises. Losses are payable only for the account of the owner of the auto.
BP 07 81 08 24 Cleaning Services
This endorsement may be used only for eligible cleaning service classifications 74261 Carpet, Rug Furniture or Upholstery Cleaning, 76231 Cleaning Services, or 76181 Window Cleaning. The endorsement provides a reward payment section to reimburse the insured up to $5,000 for rewards paid for information leading to the arrest and conviction of any persons committing a crime resulting in loss or damage to covered property or for the return of stolen covered property when caused by theft. Up to $1,000 (with a $100 deductible) is available for the cost to repair or replace locks at the client's residence due to theft or other loss to keys entrusted to the insured by the client.
Loss of or damage to money, securities, or other property sustained by a client resulting directly from theft committed by an identified employee is covered. Only the insured can make a claim under this insurance.
Up to $5,000 for one occurrence and $10,000 in any annual period of "your work" coverage is added to the liability section of the Businessowners form, which reimburses the insured for property damage claims arising directly from "your work" for a client. The insured must notify the insurer as soon as possible of the notification from a client of a demand for remuneration for property damage resulting from "your work."
A definition of "other property" is added to the property section.
The 08 24 edition of the form removed the word 'Residential' from the title of the endorsement in conformity with that same revision that was made to the contractor classification.
This endorsement is available for any risks with a photographer classification. Of importance to note is that when this endorsement is added, endorsement BP 16 39 Broad Abuse Or Molestation Exclusion Endorsement, must also be attached. See also endorsement BP 07 87, described below.
On endorsement BP 07 83, business personal property includes the insured's employees' photographic equipment used in connection with the insured's business as a photographer and property of others in the insured's care, custody, or control except as otherwise excluded. The 08 24 edition of this form contains revisions that expand the coverage radius to 1,000 feet, where applicable, in conformity with the same coverage radius expansion in the underlying Businessowners Coverage Form BP 00 03.
The endorsement provides a reward payment section to reimburse the insured up to $5,000 for rewards paid for information leading to the arrest and conviction of any persons committing a crime resulting in loss or damage to covered property or for the return of stolen covered property when caused by theft.
A coverage extension is added for covered photographic equipment the insured owns, covered photographic equipment of others in the insured's care, custody, or control, or covered employees' photographic equipment while in the course of transit or at a premises the insured does not own, lease, or operate. The limit is $5,000 per item and $25,000 per occurrence. A Supplemental Photographic Equipment Schedule BP DS 07 may be used to individually describe and schedule photographic equipment to increase the limits.
A per-item limit of $5,000 for loss or damage to unscheduled photographic equipment is added to apply to photographic equipment at the described premises or in the open or in a vehicle within 1,000 feet of the premises. A limit for scheduled items should be shown in the schedule.
Loss of or damage to money, securities, or other property sustained by a customer resulting directly from theft committed by an identified employee is covered. Only the insured can make a claim under this insurance.
The definition of "other property" was added to the property definitions section.
The endorsement adds coverage to the liability section for sums the insured becomes legally obligated to pay as damages because of a failure to deliver photographic product to customers due to loss or damage of photographic film or electronic media in connection with the operation of the insured's business as a photographer. The damages must exceed $250. The insured must notify the insurer as soon as practicable of an event that may result in a claim.
The following definitions are added to property and liability definitions sections: "photographic equipment" and "photographic product."
BP 07 84 07 13 Photography – Makeup and Hairstyling
This endorsement does not apply the professional services exclusion to makeup application or hairstyling services provided in connection with the insured's business as a photographer. The form also adds definitions of "makeup application" and "hairstyling services" to the liability definitions section.
BP 07 87 07 13 Photography – Amendment of Coverage Territory for "Photographic Equipment" – Worldwide Coverage
This endorsement expands the coverage territory with respect to photographic equipment temporarily located away from the premises. Coverage applies anywhere in the world except countries or jurisdictions specified on the schedule and countries or jurisdictions subject to trade or other economic sanctions or embargos by the United States.
