The New Mexico Office of Superintendent of Insurance (OSI) published a bulletin informing automobile insurers that they are required to disclose certain uninsured motorist and underinsured motorist (UM/UIM) information to policyholders.

In Kileen v. Didio, 2025 LX 264217 (N.M. 2025), the New Mexico Supreme Court ruled that insurers must offer UM/UIM coverage on a per-vehicle basis to be consistent with the state’s UM/UIM statute and public policy. The court reasoned that offering coverage on a per-vehicle basis gives consumers the option to acquire coverage they can afford, as opposed to being in a position where they either buy coverage on all vehicles on a policy or buy no coverage at all.

As a result, OSI is requiring insurers to include per-vehicle disclosure and exclusion forms in their auto policies and auto insurance applications to inform consumers of their options and provide the premium cost per vehicle. This applies to personal, commercial, and fleet automobile policies.

OSI provides examples of disclosures that may be used by insurers, which are attached in the bulletin. Insurers may also develop and use their own disclosures by filing with OSI for review.
