The Delaware Department of Insurance published a bulletin providing information to insurers about filing fee requirements, per Delaware statutes.

HB 242 established a $2,000 filing cap for filings made on a group-wide basis. There is no fee for an informational filing. If an insurer requests to withdraw a filing, it may be withdrawn and the fee refunded if the request is made prior to the Department processing the filing. If the Department has already taken action on the filing, no refund will be issued.

If an insurer’s filing fee is insufficient, they will be notified through SERFF and have seven days to pay the correct amount. If they don’t, the filing will be rejected and there will be no refund of the fee paid.
