The Colorado Division of Insurance published a news release announcing the adoption of Regulation 5-1-27: Concerning Requests for Commercial or Personal Automobile Policy Information From a Claimant or Claimant’s Attorney and Policyholder’s Requests for a Certified Copy of the Homeowner Insurance Policy.
Simply put, the regulation establishes rules for how insurers must respond to certain policy information requests from a registered agent. For commercial and personal automobile policy limit requests, insurers are required to respond within 30 calendar days from the date their registered agent receives a written request. Insurers must provide a copy of the policy, which may include the declarations page or the application. Insurers must retain the requests and their responses for the current year and the prior two years.
Similarly, when a policyholder requests a certified copy of their homeowner insurance policy, insurers must make it available within 30 calendar days of receiving the written request through their registered agent. Policyholder requests and documentation showing the policies were made available to the policyholder must also be retained for the current year and the prior two years.
The regulation is effective November 30, 2025. Noncompliance may result in civil penalties, a cease and desist order, or suspension or revocation of an insurer’s license.
