The Texas Department of Insurance published a bulletin reminding insurers of Senate Bill 1238, which prohibits an insurer from discriminating based on an insured’s marital status following the death of their spouse.
Senate Bill 1238, effective September 1, 2025, prohibits an insurer from refusing to continue to provide coverage, or limit the amount or extent of coverage, to an insured because the insured is widowed. Additionally, insurers may not charge a widowed insured a higher rate than the rate that would have been charged if their marital status were still married.
All policies delivered or renewed on or after September 1, 2025, must comply with the statute.
