Insured has HO-3 form, and owns a golf cart on premises to maintain residence property. The insured lives in a rural area, does not play golf and the golf cart never leaves the residence premises. During a storm, the wind blew a tree on top of the golf cart, completely destroying the golf cart.

Please advise on property damage coverage under HO-3 ?

Under the HO 00 03 03 22, motor vehicle is defined as a land or amphibious vehicle that is self-propelled or capable of being self-propelled. Therefore, the golf cart is a vehicle. Motor vehicles are excluded from property coverage, but an exception exists for vehicles not required to be registered for use on public roads or property, and are either used solely to service a residence or designed to assist the handicapped. Therefore the golf cart would be covered.

Personal property is named perils coverage. Falling objects is one of the named perils, and the only provision is that if the property is contained in a building, the roof or outside wall must first be damaged by a falling object.

Therefore, the golf cart would be covered for damage from the fallen tree limb.
