The Delaware Department of Insurance published a bulletin summarizing all of the insurance laws enacted in the 2024 Session of the Delaware General Assembly. The laws are presented in categories of Property and Casualty, General Bills, Workers Compensation, Life and Health, and Captive.

Property and Casualty

SB 200 and HA 1 – Property Insurance Contracts

Effective October 1, 2024, this bill amends the Delaware Insurance Code to require insurers to deliver notices of cancellation or nonrenewal of homeowners policies by USPS certified mail or USPS Intelligent Mail barcode. The bill does not otherwise eliminate or reduce an insurer's ability to communicate with consumers electronically. 

In addition, the bill states insurers may not nonrenew a homeowners policy because of non-weather claims unless at least two claims occurred within a 60-month period. 

HB 379 – Agent-Issued Insurance Payments

Effective June 6, 2024, this bill amends the Delaware Insurance Code to permit insurance agents to issue checks to policyholders without having to qualify as claims adjusters in time-sensitive scenarios. The Department plans to implement a new regulation that would address the scenarios where an agent or broker may adjust claims.

General Bills

SB 306 – Workplace Safety Program

Effective January 17, 2025, this bill removes the previous eligibility criteria where only employers paying $3,161 or more in annual workers' compensation premiums qualify for the program. More on that here.

HB 283 – Licensing and Fee Bill

Effective August 2, 2024, this bill centralizes into one statutory provision the licensing and filing fees of managed care organizations, dental plan organizations, fraternal benefit societies, and captive insurance companies.
