The Oklahoma Insurance Department published a bulletin publicizing two recent rule changes related to the insurance industry. One has to do with motor vehicle repairs and the other requires an annual provider directory audit report for health benefit plan insurers.
OAC 365: 15-1-26 states that insurers should conduct a market survey of the prices charged for motor vehicle repairs within the core based statistical area (CBSA) where the repair facility is located. This survey is to be used to establish a competitive price for vehicle repairs.
Insurers can use automobile repair estimating software to determine competitive prices if the software complies with all other applicable laws. Market surveys should be updated regularly to reflect the current market conditions. If requested by the Department, insurers must provide copies of their market surveys and other relevant documentation within 20 days.
OAC 365: 10-1-18 states that each health benefit plan must have a way for the public to report inaccurate information and must also self-audit for inaccuracies at least once a year. An annual provider directory audit report is due by March 1, 2025, and every March 1st after.
