The South Carolina Department of Insurance published a notice informing all insurers authorized to write property and casualty insurance in the state they are required to complete the Liability Data Call spreadsheet (note that this link will automatically download an Excel spreadsheet). 

South Carolina, along with other states, have had their liability markets harden enormously over the past few years. The South Carolina General Assembly has instructed the Department to determine why there are liability insurance affordability and availability issues in the state, compare South Carolina liability insurance markets and regulatory requirements with those of nearby states, and make recommendations based on its findings. The General Assembly aims to soften and stabilize the market.

The Liability Data Call is one method by which the Department seeks to complete the General Assembly's request. It must be completed by all authorized property and casualty insurance companies, including surplus lines insurers, writing liability coverage. This data call does not apply to health insurers, monoline financial guaranty, mortgage guaranty, title, fidelity and surety, workers' compensation, or reinsurers.

The spreadsheet should be completed using only data related to liability insurance coverage. The following programs/elements should be omitted from the report: E&O, D&O, umbrella, excess-of-loss, large deductible, employment liability, and contractual liability. The Department will keep individual responses confidential, and all responses will be aggregated for public disclosure.
