Summary: Category 25 of ISO crime forms consists of forty-nine various endorsements that change certain crime policy provisions. The endorsements have been developed to modify provisions in the crime and fidelity forms and policies. Most of the endorsements were revised in June 2022, a few were revised in 2010 or earlier, and a new endorsement was added in May 2023. The endorsements are presented in numerical order. In many of the updates minor formatting or editorial changes have been made, while others have more significant changes. Because there are so many endorsements, we have broken them into sections as follows:

The insured is allowed to add blanket excess coverage for specified joint insureds by using this endorsement. The blanket excess limit of insurance shown in the Schedule applies in addition to the Limit Of Insurance shown in the Declarations. The limit applies only to loss caused by or involving any "employee" who is an "employee" of any insured shown in the Schedule of this endorsement. This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
Excess coverage over a statutory bond for bonded employees or treasurers/tax collectors is provided in this endorsement. It removes the exclusions in the crime policies that apply to these employees. Coverage is provided for loss caused by these employees that is in excess of the amount of any individual bond requirement, whether or not the bond is in force or valid and collectible. This endorsement can be used with the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
Excess "per loss" insurance under the governmental crime form is provided in this endorsement. The insurer will first pay up to the Limit of Insurance under Employee Theft – Per Employee. If loss is in excess of that, the insurer will pay an additional amount up to the Limit of Insurance under Employee Theft – Per Loss Coverage shown in the Declarations. This endorsement can be used with the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
CR 25 34 allows an insured to add excess limits of insurance for named employees or ERISA Plan Officials, or by title and location of covered positions. If the excess limit of insurance is scheduled on a position basis, the most the insurer will pay for an employee holding more than one position is the largest excess limit of insurance in effect and applicable to any one of those positions.
The endorsement amends the definition of "employee" to mean any person named in the Schedule if coverage applies on a Name Schedule basis; or any person you engage to perform the duties of a position shown in the Schedule if coverage applies on a Position Schedule basis.
This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
This endorsement is similar to CR 25 43, seen above, and allows an insured to add excess limits of insurance for scheduled employees or positions, but for the peril of employee theft only. ERISA Plan Officials are not included in this endorsement, as ERISA Regulations require coverage for fraudulent or dishonest acts, not employee theft.
This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
The items shown in the Schedule of this endorsement are in addition to or a deletion from the item or items appearing in the Schedule of the Employee Theft – Name Or Position Schedule Insuring Agreement or a prior version of this endorsement CR 25 36. The change in listed employees applies to damages that result from an "occurrence" which is "discovered" by the insured on or after the effective date of the change. Any changes made by a retroactive date endorsement supersede this endorsement.
This endorsement applies to discovery forms only and can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
This endorsement is the same as the 25 36 endorsement, seen above, except it applies to loss sustained forms and not discovery forms. It can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
CR 25 38 allows for additions or deletions to be made to prior schedules that exist under endorsement CR 25 34, CR 25 35, or earlier versions of this endorsement, CR 25 38. The changes are the same as what we have discussed in endorsements 25 26 and 25 27. This is a discovery form. The 2022 revision of this endorsement includes ERISA Plan Officials, and gives the option to select the new ERISA Plan Official Dishonesty Insuring Agreement in the Schedule, in addition to the Employee Theft Insuring Agreement. This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
This endorsement is the same as CR 25 38, seen above, except it applies to loss sustained forms and not discovery forms. It can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
CR 25 40 allows an insured to include incurred expenses to establish the amount of a covered loss under the employee theft insuring agreement or the computer fraud and funds transfer fraud insuring agreement. Reasonable costs, fees, or other expenses that are paid to an independent accounting, auditing, or other service in order to determine the amount of the loss are covered. The insurer will pay only after settlement of covered losses, and is not liable for any amount that does not exceed the applicable deductible. The most the insurer will pay is the lesser of the Limit shown, or a designated percentage of the covered loss shown in the Schedule. The limit is a part of, not in addition to, the Limit of Insurance for the applicable Insuring Agreement.
