Summary: There are a multitude of ISO commercial auto endorsements, and year by year, the list keeps growing. Rather than attempt a discussion of all of the endorsements in one commentary, we have provided a listing, brief discussion and explanation of each of the endorsements by the way they are categorized by ISO – Amendatory endorsements (Categories 01 and 05), Cancellation and Suspension endorsements (Category 02), Deductible endorsements (Category 03), Additional Coverage endorsements (Category 04), Specialized Types endorsements (Category 20), Uninsured Motorists endorsements (Category 21), No-Fault endorsements (Category 22), Commercial Auto endorsements (Category 23), Public Transportation endorsements (Category 24), Garage endorsements (Category 25), Single Interest endorsements (Category 26), Additional Garage endorsements (Category 27), Special Types endorsements (Category 28), and Common Coverages and Rating Procedures endorsements (Category 99).

The first of these commentaries addressed Categories 01, 02, 03 and 05.

The next categories of endorsements discussed were Categories 04, Additional Coverage endorsements, and 20, Specialized Types endorsements, then 23 – Commercial Auto endorsements. These are varying endorsements that address certain exposures and coverages not otherwise categorized.

Next, we discussed endorsements in Category 26 – Single Interest endorsements; and then lastly, endorsements in Category 27 – Additional Garage endorsements, and the single endorsement in Category 28 – Special Types.

Auto Medical Payments Coverage CA 99 03

This endorsement CA 99 03 10 13 is used to provide auto medical payments coverage to the Business Auto Coverage Form, the Motor Carriers Coverage Form, or the Auto Dealers Coverage Form.

Business Interruption Coverage CA 99 05

Endorsement CA 99 05 11 20 may be attached to provide coverage for business interruption that results from direct and accidental loss or damage to scheduled property, as long as such property is located within the coverage territory.

Drive Other Car Coverage – Broadened Coverage For Named Individuals CA 99 10

Within the Auto Dealers Coverage Form, coverage is provided for an auto dealer individual named insured. Coverage may also be provided for an indivdual named insured who owns a private passenger auto, but who is not an auto dealer. In all cases, drive other car coverage includes coverage for the spouse, or an equivalent. For all other circumstances, endorsement CA 99 10 10 13 can be used to add drive other car coverage for scheduled individuals with respect to autos not owned, hired, or borrowed while a covered auto is being used by that scheduled individual, or their spouse while a resident of the same household. Coverage however does not extend to autos owned by that individual or any member of their household, or for the spouse while working in a business of selling, servicing, repairing or parking autos.

Fiduciary Liability of Banks CA 99 13

This endorsement CA 99 13 10 13 excludes liability in a fiduciary capacity for bodily injury or property damage that occurred before such time as the insured had liability in such a capacity.

Fire, Fire And Theft, Fire, Theft And Windstorm And Limited Specified Causes Of Loss Coverages CA 99 14

This endorsement CA 99 14 11 20 allows an insured to select specified coverages per covered auto for other than collision coverage, as shown in the endorsement schedule. The 11 20 edition of the form removes references to the physical damage coverage limit, as these limits are already addressed under the coverage form's physical damage limit of insurance provision.

Governmental Bodies Amendatory Endorsement CA 99 15

This endorsement CA 99 15 12 93 is only available to amend the business auto coverage form. If the sole reason for considering a land motor vehicle or trailer as mobile equipment is due to it being solely used on roads owned by the insured, this endorsement can be used to provide coverage for such vehicle or trailer as an auto instead of  mobile equipment, if it is owned or leased by the insured and is designed for travel on public roads.

Hired Autos Specified As Covered Autos You Own CA 99 16

Endorsement CA 99 16 10 13 is used to provide additional insured coverage to the owner of an auto the insured hires, borrows or leases. Such auto must be shown in the schedule to effect the coverage.

Individual Named Insured CA 99 17

Endorsement CA 99 17 10 13 may be used to provide  drive other car coverage for family members under the business auto coverage form or the motor carrier coverage form. (The auto dealers coverage form already provides drive other car coverage for an insured who is an auto dealer.) The family drive other car coverage applies if the policy covers a private passenger auto rented to others without a driver, as long as it is not used for public transporation; or a pickup, panel  truck, or van that is not used in the business of the insured other than for farming or ranching. A family member is a person related to the named insured by blood, marriage or adoption who resides in the insured's household, including a ward or foster child. There is no charge for this endorsement.

Rental Reimbursement Coverage CA 99 23

Coverage can be added for rental reimbursement associated with loss to a covered auto by use of endorsement CA 99 23 10 13. The covered auto must be scheduled on the endorsement with the indicated coverage of comprehensive, collision or specified causes of loss, for a specified period of time, but not less than 30 days. The minimum limit of coverage that can be purchased is $15 per day. Reimbursement is available for expenses incurred beginning 24 hours after the loss, which serves as a waiting period. No other deductible applies to the coverage. The coverage period ends at the lesser of either the number of days it takes to repair or replace the covered auto; or the number of days designated in the endorsement schedule. In the event the loss is caused by theft, the number of days is added to the number of days that it takes to locate and return the auto to the insured.  The coverage cannot be used if the insured has access to other autos available to use in the operations.

Split Liability Limits CA 99 27

This endorsement CA 99 27 01 87 may be used to change the liability combined single limit (CSL) to split limits that apply to each of the bodily injury and property damage coverages.

Stated Amount Insurance CA 99 28

For autos that may not be easily replaced with like kind and quality, such as collector autos, kit autos, or other one of a kind vehicles, the insurer and insured can make use of the stated amount endorsement CA 99 28 11 20. The effect of this endorsement is to limit the amount of physical damage coverage to the least of the following, less the deductible: the property's actual cash value at time of loss (less depreciation); the repair or replacement cost with property of like kind or quality (but not for any betterment); or at the amount stated in the schedule. Stated amount is not agreed value. For example, an insured may pay $50,000 for a vehicle but choose to only insure it for the stated amount of what is stilled owed on their loan, such as $20,000.

Tapes, Records and Discs Coverage CA 99 30

Endorsement CA 99 30 10 13 can be used to provide a limited amount of physical damage coverage for tapes, discs and other similar devices used in connection with premanently installed audio, visual or data electronic equipment, up to a maximum of $200 per loss. Coverage is restricted to property that is owned by the insured or family members, that is in the covered auto at the time of the loss.  Coverage is provided on a per auto basis for those autos listed in the endorsement schedule.

Employees as Insureds CA 99 33

Endorsement CA 99 33 10 13 may be used to cover the liability of non-owned, hired or borrowed autos used in connection with the insured's business operations or in the personal affairs of the insured employer. This would cover the individual liability of employees, including those of auto service operations, while such vehicles are being used in this manner.

Garagekeepers Coverage CA 99 37

Non-owned autos in the insured's possession may be covered while the insured is attending, servicing, repairing, parking or storing such autos by use of endorsement CA 99 37 10 13. Coverage may be provided on either an excess or primary basis.

Split Liability Limits – Garages CA 99 38

This endorsement CA 99 38 01 87 is like endorsement CA 99 27, except that this endorsement applies only to the garage coverage form.

Exclusion Or Excess Coverage Hazards Otherwise Insured CA 99 40

When an insured has other insurance in place for certain autos, endorsement CA 99 40 10 13 may be used to exclude those autos from the covered autos liability coverage. Options are provided to designate the specific time that other insurance ends, or to only have the exclusion apply for limits that are less than the limits of insurance under this policy, which would make this policy excess over that other insurance.

Loss Payable Clause CA 99 44

Endorsement CA 99 44 10 13 may be attached to cover the financial interests of a loss payee, without the need to specifically name the loss payee.

Employee as Lessor CA 99 47

When an auto is leased to an insured by an insured's employee, such auto can be scheduled on endorsement CA 99 47 10 13 and the employee will be given auto liability coverage the same as an insured.

Pollution Liability – Broadened Coverage For Covered Autos – Business Auto And Motor Carrier Coverage Forms CA 99 48

Endorsement CA 99 48 10 13 is a broadening pollution cost endorsement for the business auto policy. The endorsement removes that portion of the pollution exclusion and the definition of covered pollution cost or expense for bodily injury, property damage, and covered pollution cost or expense that relates to the discharge of pollutants which are in, upon, being transported or towed by, or being loaded onto or unloaded from a covered auto. The broadened coverage does not apply to liability assumed under contract or agreement. The endorsement allows for pollution cleanup costs from accidents that occur away from insured premises if the pollutants or its container were upset, overturned or damaged due to maintenance or use of a covered auto; and pollutant release or escape is directly caused by that upset, overturn or damage. The coverage will not apply if the pollutants were in or on a covered auto at the time of the accident. So for example, if an insured drives a covered auto onto a gas station lot and crashes into a gas pump, this will cover the cleanup costs from the discharged fuel from the gas pump.

Covered Auto Designation Symbol CA 99 54

The covered auto designation symbol endorsement CA 99 54 10 13 adds a symbol 10 to the business auto policy to enable scheduling of a particular auto(s) to be covered that is not otherwise covered under the policy. This same endorsement adds symbol 32 to the auto dealers coverage form for the same purpose.

Pollution Liability – Broadened Coverage For Covered Autos – Auto Dealers Coverage Form CA 99 55

Endorsement CA 99 55 10 13 is a broadening pollution cost endorsement for the auto dealers coverage form. The endorsement acts in the same manner as endorsement CA 99 48 described above except for the auto dealers coverage form.

Garagekeepers Coverage – Customers' Sound-receiving Equipment CA 99 59

Endorsement CA 99 59 10 13 can be added to the commercial auto policy to provide comprehensive and collision coverage for sound-receiving equipment in an insured garage's care, custody or control. Such equipment must be permanently installed in the customer's auto, and it does not apply to any type of speed detecting equipment. Also, this coverage is not available for theft of sound-receiving equipment. Coverage can be provided on either an excess or primary basis, as indicated by the appropriate selection on the endorsement.

Audio, Visual And Data Electronic Equipment Coverage Added Limits CA 99 60

This endorsement CA 99 60 10 13 is available only for covered autos written on an actual cash vaue basis. The endorsement permits scheduling of an increased 'per loss' limit to apply to physical damage of electronic equipment that at the time of covered loss, is permanently installed in or upon the covered auto in a housing, opening, or other location not normally used by the auto manufacturer for the installation of such equipment; or for equipment that is removable from such permanently installed housing unit or any integral part of such equipment. The per loss limit scheduled on the endorsement applies only to those autos described in the endorsement and the limit applies in addition to the physical damage limit that otherwise applies to that covered auto(s).

Loss Payable Clause – Audio, Visual And Data Electronic Equipment Coverage Added Limits CA 99 61

Endorsement CA 99 61 10 13 provides the same type of coverage as endorsement CA 99 60, except that this endorsement also provides coverage for the loss payee named in the schedule of the endorsement.

Optional Limits – Loss Of Use Expenses CA 99 90

Endorsement CA 99 90 10 13 makes provision for covering the loss of use expenses for hired auto physical damages an insured becomes legally responsible to pay under a written contract or agreement when a vehicle is rented or hired without a driver. The limits of the endorsement are $30 per day, up to a maximum of $900. Coverage will follow the policy coverage, be it other than collision, specified causes of loss, or collision.
