On July 1, 2023, the Florida Office of Insurance Regulation issued emergency rule 69OER-23-2, regarding minimum requirements for claims-handling manuals. Authorized residential property insurers are required to attest and certify that their manuals meet the specifications of the law, that there are adequate resources available to implement those manuals, and that they will provide copies of the claims-handling manuals upon request. The first required certification and attestation of the manuals must be filed by insurers by August 1, 2023, on the required forms, which may be found here and here.

Further, on July 18, 2023, the department issued an informational memorandum,  again notifying insurers of the new requirement. Once the initial attestation and certification of the claims-handling manual have been completed, the same or similar attestations will need to be filed annually on May 1 through the department, with details on those submissions forthcoming. The department may request copies of the manuals and if so manuals are to be provided to the department within five days of the request and accompanied by the proper attestation form.
