The Occupational Safety and Health Administration (OSHA) has levied nearly $1.2 million in fines against a Massachusetts demolition company following an investigation into the death of a worker. JDC Demolition (JDC) was cited for eleven total violations: eight willful violations at $145,027 per violation; two serious violations at $14,502 each; and one "other than serious" violation for $2,072.
Peter Monsini, a newly-hired JDC Demolition (JDC) employee, was using an excavator to help tear down a government parking garage in Boston when part of the garage collapsed; the excavator, with Monsini inside, plummeted 80 feet, killing Monsini. He was 51.
The investigation revealed that JDC had gone against its demolition plan the morning of the incident, placing heavy machinery, including the ill-fated excavator, on top of floors that had been partially demolished. One employee operating another piece of heavy machinery on the floor that would collapse brought up concerns related to this issue, but they were ignored. Monsini, working his first day with JDC, was sent to operate the excavator; he received neither a safety briefing nor any training on the company's demolition plan for the garage.
OSHA also cited general contractor John Moriarty and Associates Inc. for four serious violations that carried nearly $59,000 in fines.
The companies have 15 business days from receiving the fines to take action.
