Auto Fraud – New Jersey

Twelve chiropractic and spine practitioners from New Jersey have been named by State Farm in a suit alleging unjust enrichment and insurance fraud. According to the complaint, the practitioners have been conspiring together since 2014 and have defrauded the insurer of $2.6 million dollars in fraudulent auto injury claims. The suit accuses the defendants of using "a predetermined protocol" that prescribed what was, in effect, the same course of treatment for all claimants without reference to true diagnostic results. Some services were not performed and others were not necessary, and the services were carried out in order to take advantage of the patients' eligibility for PIP benefits. The complaint also alleges that some of the defendant chiropractors made illegal referrals to diagnostic clinics they owned in order to follow that predetermined protocol without considering the circumstances of the unique cases.
