The lawsuit, filed by Gordon Rees Scully Mansukhani, seeks declaratory judgment that the insurer has no obligation under an environmental policy to provide coverage in connection with a 2022 avian influenza outbreak. Evanston contends that the outbreak, which led the egg producer to cull millions of chickens, is not covered because it does not constitute, result from, or arise out of a 'pollution condition.' Lawyers have not yet appeared for the defendant.
