Please provide us with your opinion as to the intent of the HO 04 95 Limited Water Back-up and Sump Discharge or Overflow Coverage. Does this limit off-premises backup (the entire neighborhood's sewer effluent backing up through the insured's sewer line into their basement) or is it meant to limit an over-flow from a clog on the insured's premise by effluent created by the insured and simply is unable to leave the premise due to a clog on-premises and thus effluent overflows from the toilets, showers etc. on-premises?

The form states that coverage is for water that originates from within the dwelling and backs up through sewers or drains, or overflows from a sump pump or related equipment. So water from off of the premises that back-up through the sewers and drains into an insured's toilet or laundry tub, for example, would not be covered under this endorsement. The keyword here is originates; the water must originate from within the dwelling.

The water exclusion for flood, surface water, water that is below the surface of the ground, etc. still applies. So if there are heavy rains that back-up the community's storm drain so that it backs up into an insured's laundry tub, this endorsement does not apply. It's designed for back-ups caused due to factors within an insured's premises.
