Gulfstream Property and Casualty Insurance Company was declared insolvent and ordered into liquidation by the Second Judicial Circuit Court in Leon County, Florida. That order has triggered the state guaranty funds in the states that Gulfstream was licensed in, which are Florida (state of domicile), Alabama, Louisiana, Mississippi, South Carolina and Texas. The Florida Department of Financial Services is the court-appointed Receiver for the Gulfstream insolvency. Information regarding the insolvency can be found on the Receiver's website.
Gulfstream Property and Casualty Insurance Company and its wholly-owned subsidiary, Gulfstream Select Insurance Company, were merged into one entity prior to the insolvency with Gulfstream Property and Casualty Insurance Company (Gulfstream) being the surviving entity. The company was located in Sarasota, Florida, and was first licensed in the state of Florida in 2004. The company was authorized to write homeowners multiple peril, mobile home multiple peril, inland marine, allied lines, fire, mobile home physical damage and other liability coverage in Alabama, Florida, Louisiana, Mississippi, South Carolina and Texas. The company had approximately 45,000 in-force policies at the time of liquidation.

Claims that are covered by the Guaranty Association will be sent to the appropriate guaranty fund for handling as soon as possible. The appropriate guaranty association will reach out as soon as possible once the claim information and data has been received.
Policy Cancellation: Under the Receivership Order, all insurance policies that were issued by Gulfstream prior to the liquidation order are cancelled effective 12:01 a.m. on August 27, 2021. Any policies with normal expiration dates prior to August 27, 2021, or which are terminated/replaced by the insured, or cancelled for non-payment of premium, will be cancelled as of the earlier date.
Florida Policies: Several other insurance carriers in Florida have expressed interest in offering replacement coverage to Gulfstream policyholders.
Alabama, Louisiana and South Carolina Policies: Centauri Specialty Insurance Company and Centauri National Insurance Company (Centauri) have an existing agreement with Gulfstream to make an offer of replacement coverage.
Unearned Premium Refunds: Unearned premium claims are covered by the state Guaranty Associations. The Florida Department is working to gather the premium data and will forward the information to the appropriate state guaranty association. Because this process can take some time during the transitional period, there may be a slight delay in the payment of unearned premium claims. The Department's website will be updated once this transition is complete.
What is a Guaranty Association?: The Guaranty Associations are nonprofit organizations established by statute in each state that respond to the insolvency and liquidation of member insurance companies such as Gulfstream. The association in the insured's state of residence will respond to any outstanding or newly reported claims prior to the claims cut-off deadline of July 28, 2022 provided the policy was in-force on the date of loss and the unearned premium claims of Gulfstream. Individuals with outstanding claims against Gulfstream should contact the appropriate state guaranty association for further information. Previously reported claims and open claims do not need to be reported again to the guaranty association as the claims records will be sent from the company to the appropriate association.

Lawsuits against Gulfstream are stayed pursuant to the Receiverships order and by Section 631-041(1) of the Florida Code. This automatic stay prohibits judicial and administrative proceedings against the company during the stay period.
Policyholders do not need to file a Proof of Claim form with the Receiver unless there is a question of whether or not it is covered by the guaranty association or exceeds the guaranty association limitation on coverage, which is generally up to $300,000 per covered claim.
Agent's Commissions and General Creditor Claims, including for work performed but not paid prior to the entry of the Gulfstream Receivership order, are not covered claims under the guaranty association statutes and a "timely" Proof of Claim will need to be filed with the receivership estate prior to the claims cut-off date set by the Liquidation Court, which is July 28, 2022. These claims will be processed by the Receiver. Proof of Claim forms can be obtained from the Receiver.
