Coverage is provided under a CP 00 10 1091, Basic cause of loss form. Loss date is December 30, 2017 and loss reported on February 20, 2018. Loss notice says vandalism, copper cut from heating/ air unit. Police report describes loss as a burglary. Copper was cut from the unit and the unit is flat to the ground. Adjuster report says the outside air conditioning unit was destroyed when an unknown person or persons took copper lines from inside the unit. No break in retail store or damage to BPP. Denial letter was issued. Retail agent and insured contesting denial.

The CP 10 10 10 91 Basic Causes of Loss form excludes loss or damage from vandalism and theft, as follows:

8. Vandalism, meaning willful and malicious damage to, or destruction of, the described property.

We will not pay for loss or damage:

a. To glass (other than glass building blocks) that is part of a building, structure, or an outside sign; but we will pay for loss or damage to other property caused by or resulting from breakage of glass by vandals.

b. Caused by or resulting from theft, except for building damage caused by the breaking in or exiting of burglars.

The theft of the copper lines was not caused by the breaking in or exiting of burglars; therefore, the loss is excluded.
