May 5, 2014

CA 00 05 03 10 defines “customer's auto” as follows: a land motor vehicle, trailer or semitrailer lawfully within your possession for service, repair, storage or safekeeping, with or without the vehicle owner's knowledge or consent. A “customer's auto” also includes any such vehicle left in your care by your “employees” and members of their households, who pay for services performed.
Our insured repairs motorcycles and ATVs. Does an ATV meet the definition of “customer's auto”. More specifically, what is the definition of “land motor vehicle” as referenced in the definition?

A land motor vehicle is just what it says it is: a vehicle that is run by motor and used on the land. The garage policy does not define a land motor vehicle so it means what the standard dictionary and the normal everyday reasonable person says it is. The standard garage form does not specifically exclude motorcycles or ATVs, so if they have motors and are used on land, they can be covered under the form.
