Modifying the CGL Coverage Form

Summary: Insurance Services Office (ISO) has a large number of standard endorsements to modify the commercial general liability (CGL) coverage forms in many significant ways; the endorsements help tailor the policy to suit underwriting requirements or to more closely meet the coverage needs of insureds in a wide variety of circumstances. The titles of most of these endorsements indicate their intent. And, the numbering of the endorsements is also instructive. For example, a general liability endorsement beginning with the numbers 20 means an additional insured endorsement; an endorsement with the beginning numbers 21 means an exclusion; 22 means special provisions for certain type of risks; and 99 is used for miscellaneous endorsements.

The listing below is for quick reference only and has only limited descriptions; some of these endorsements are described in more detail in the Public Liability section of the Casualty & Surety volume, page B.1; see CGL Endorsements.

Deductible

The CGL coverage forms have no deductible provision. Endorsement CG 03 00 01 96 is used to add a deductible to the CGL forms. The endorsement may be adapted to apply either per claim or per occurrence, and to either bodily injury or property damage or both coverages combined.

CG 03 00—Deductible Liability Insurance (applicable to the CGL coverage part and the products/completed operations coverage part)

Additional Coverage

Pollution Liability Coverage Extension CG 04 22 11 85

This endorsement deletes paragraph (1) of the pollution exclusion; paragraph (2), the cleanup costs section of the exclusion, is not modified by CG 04 22.

Coverage for Injury to Leased Workers CG 04 24 10 93

With respect to employer's liability exclusion, the definition of employee is changed by this endorsement to state that an employee does not include a leased worker and does not include a temporary worker—for use with CGL, liquor liability, OCP, pollution, and products/completed operations policies.

Pollution Exclusion—Named Peril Limited Exception for a Short-Term Pollution Event CG 04 28 12 04

This is an optional endorsement that replaces the pollution exclusion on the CGL forms with a revised version of that exclusion that allows liability coverage for a short-term pollution event that would not have taken place but for a named peril. Both “short-term pollution event” and “named peril” are defined on the endorsement.

Pollution Exclusion—Limited Exception for a Short-Term Pollution Event CG 04 29 12 04

This endorsement is the same as CG 04 28 except that the term “named peril” is not used; in other words, a short-term pollution event is covered on an open perils basis. A short-term pollution event is still an event limited by its definition.

Pollution Exclusion—Limited Exception for Designated Pollutant(s) CG 04 30 09 99

This optional endorsement modifies the pollution exclusion of the CGL forms by adding an exception that allows liability coverage for BI or PD arising out of the discharge, dispersal, release, etc., etc. of the pollutant(s) listed in the schedule on CG 04 30. The listed pollutants have to be used in connection with the insured's operations.

Year 2000 Computer-Related and Other Electronic Problems—Limited Coverage Options CG 04 31 09 98

This endorsement deletes insurance coverage for BI, PD, or personal and advertising injury arising out of Y2K problems, and then, gives coverage back for the types of injury or damage indicated on the endorsement's schedule, arising out of the operations, products, services, or locations that are also scheduled on CG 04 31.

Employee Benefits Liability Coverage CG 04 35 03 05

This endorsement has a schedule on it that allows the insured to list the limits of insurance per each employee and in the aggregate, and to choose the deductible per each employee. The insuring agreement is for damages because of any act, error, or omission of the insured negligently committed in the administration of the named insured's employee benefit program. The coverage is on a claims-made basis.

Limited Product Withdrawal Expense CG 04 36 12 04

This endorsement provides reimbursement to the named insured for expenses incurred because of a covered product withdrawal; it does not provide any liability coverage or coverage for the cost or expense of defending any claim or lawsuit.

Additional Insured

There are many situations calling for naming additional insureds under the liability coverage. There are also many endorsements, each addressing a specific situation.

CG 20 02 11 85—(add insured) Club Members.

Club members are added as additional insureds but only with respect to their liability for activities of the club or activities they perform on behalf of the club.

This endorsement is used when contractual liability coverage is provided to the named insured, in contrast to endorsement CG 20 09.

This endorsement covers the person or organization named in the endorsement for liability arising out of the ownership, maintenance, or use of the premises leased to the named insured and scheduled in the endorsement.

The vendor named in this endorsement is covered for bodily injury or property damage arising out of the products described in the endorsement that are sold or distributed in the vendor's business.

This endorsement is designed to provide coverage to a person or organization as an additional insured, whose status may not otherwise qualify for one of the other specific additional insured endorsements listed in this article.

CG 20 35—Additional Insured—Grantor of Licenses—Automatic Status When Required by Licensor

This endorsement extends insured status to a grantor of licenses when the named insured and the grantor have agreed in writing in a contract that the grantor is to be named as an additional insured. CG 20 35 offers automatic status as an additional insured to license grantors when required by contract. CG 30 36 10 01 provides such status only when the grantor of the license is scheduled on the endorsement.

CG 20 37—Additional Insured—Owners, Lessees, or Contractors—Completed Operations CG 20 37 07 04

This endorsement amends the who is an insured section of the CGL form to include as an insured the person or organization shown in the schedule of CG 20 37. This is only with respect to liability arising out of the named insured's work at the location designated and described in the schedule, and included in the products-completed operations hazard.

Exclusions

There are many situations when either an insured or an insurer will desire to exclude certain coverages or exposures that may otherwise be provided by or be potentially within the coverage of the CGL form. The following endorsements can be used for the purposes as noted.

CG 21 01—(excl) Athletic or Sports Participants

CG 21 04—(excl) Products/Completed Operations Hazard. CG 21 04 11 85

This endorsement should not be used when an insured's classification code automatically includes products liability coverage as part of the premises-operations exposure.

CG 21 16—(excl) Designated Professional Services CG 21 16 07 98

CG 21 17—(excl) Movement of Buildings or Structures

CG 21 33—(excl) Designated Products.

This endorsement can be attached to either the CGL form or the products/completed operations liability coverage part.

CG 21 34—(excl) Designated Work.

This is an ideal exclusion when a construction contractor is performing certain work under a wrap-up program being handled on an “ex-insurance” basis; that is, where the project owner or general contractor is providing all the insurance.

The current version clarifies that the exclusion also applies to employees and volunteer workers who operate autos, aircraft, or watercraft in the course of employment by the insured)

The effect of this endorsement is to limit contractual liability coverage to the equivalent of what is known as an “incidental contract” under the 1973 comprehensive general liability policy provisions.

This endorsement is intended to eliminate whatever environmental impairment coverage that would otherwise remain under the CGL form after application of exclusion (f).

CG 21 50—Amendment of Liquor Liability Exclusion

CG 21 52—Exclusion—Financial Services (for use with CGL policies)

CG 21 53—Exclusion—Designated Ongoing Operations (for use with CGL policies).

A situation when this endorsement might be appropriate is when a particular work project is being covered under a separate CGL policy.

CG 21 54—Exclusion—Designated Operations Covered by a Consolidated (Wrap-Up) Insurance Program (for use with CGL policies)

CG 21 55—Total Pollution Exclusion With A Hostile Fire Exception (for use with CGL policies).

This endorsement does not modify the portion of the pollution exclusion that eliminates coverage for cleanup costs.

CG 21 56—Exclusion—Funeral Services (for use with CGL policies).

Under ISO rules, this endorsement is mandatory for CGL forms for cemeteries, crematories, funeral homes, chapels, and mausoleums.

CG 21 57—Exclusion—Counseling Services (for use with CGL policies).

This endorsement is mandatory for CGL forms on mission, settlement, or halfway houses.

CG 21 58—Exclusion—Professional Veterinarian Services (for use with CGL policies).

This endorsement is mandatory for CGL forms on veterinarians and veterinary hospitals.

CG 21 59—Exclusion—Diagnostic Testing Laboratories (for use with CGL policies)

This endorsement is mandatory for CGL forms on medical or X-ray laboratories.

CG 21 60 —Exclusion—Year 2000 Computer-Related and Other Electronic Problems. CG 21 60 09 98

This Y2K exclusion applies to BI, PD, and personal and advertising injury arising directly or indirectly out of the failure or malfunction of computer hardware and software, networks and systems, or any other products and services that rely on these items due to the inability to correctly recognize, process, or accept the year 2000 and beyond.

CG 21 62—Exclusion—Year 2000 Computer-Related and Other Electronic Problems With Exception for Bodily Injury on Your Premises. CG 21 62 09 98

This endorsement is the same as CG 21 60 except that the exclusion does not apply to BI occurring on any premises owned by or rented to the named insured.

CG 21 63—Year 2000 Computer-Related and Other Electronic Problems—Exclusion of Specified Coverages for Designated Locations, Operations, Products, or Services. CG 21 63 09 98

This endorsement applies the Y2K exclusion to the coverages scheduled on the endorsement that arise out of the operations, products, services, or locations that are also scheduled on the endorsement.

CG 21 65—Total Pollution Exclusion With a Building Heating Equipment Exception and a Hostile Fire Exception. CG 21 65 12 04

This endorsement replaces the pollution exclusion as written on the CGL form. It is a total pollution exclusion except for BI caused by smoke, fumes, and vapor from heating equipment; and except for BI or PD arising out of heat, smoke, or fumes from a hostile fire.

CG 21 66—Volunteer Workers Exclusion CG 21 66 12 04

The current CGL form includes volunteer workers as insureds and as eligible for med pay coverage. This endorsement excludes such coverage if the named insured chooses to use it.

CG 21 69—War or Terrorism Exclusion CG 21 69 01 02

This endorsement rewords the war exclusion on the CGL form to include not only war but also warlike action by a military force and terrorism. Terrorism is defined on the endorsement and CG 21 69 notes that terrorism part of the exclusion applies when the following happens: total of insured damage to all types of property exceeds $25,000,000; fifty or more persons sustain death or serious physical injury; the terrorism involves the use of nuclear materials or radioactive contamination, biological or chemical materials.

Endorsements for Special Risks

An insured might have a liability exposure that requires special handling, that is, separate coverage has to be arranged for the exposure. The following endorsements remove the coverage from the CGL form or define the coverage more narrowly so as to avoid it.

CG 22 24—Inspection, Appraisal, and Survey Companies (professional services excluded)

CG 22 27—Bodily Injury to Railroad Passengers (excluded)

CG 22 28—Travel Agency Tours (“coverage territory” excludes foreign tours, other than tours to Puerto Rico and Canada)

CG 22 29—Property Entrusted (to miniwarehouses and security agencies, commonly entrusted with property of others, excluded from PD liability coverage)

CG 22 30—Corporal Punishment.

This endorsement excludes coverage for bodily injury, property damage, personal injury, or advertising injury to the student of the named insured, arising out of any corporal punishment administered by or at the direction of any insured.

CG 22 31—Riot, Civil Commotion or Mob Action (governmental subdivisions not covered for injuries arising out of these exposures)

CG 22 32—Professional Services Exclusion—Blood Banks

CG 22 33—Exclusion—Testing or Consulting Errors and Omissions

CG 22 34—Construction Management Errors and Omissions (excluded, except for BI or PD arising out of actual construction or demolition activity)

CG 22 36—Products and Professional Services (of druggists, excluded; but see CG 22 69)

CG 22 37—Products and Professional Services (Optical and Hearing Aid Establishments)—but see, also, endorsement CG 22 65

CG 22 38—Exclusion—Fiduciary or Representative Liability of Financial Institutions CG 22 38 07 98

CG 22 39—Camp or Campground (medical professional excluded if camp or campground runs an infirmary)

CG 22 40—Medical Payments to Children (excluded in policy for day care center)

CG 22 41—Housing Projects (eliminates coverage at the site of a proposed housing project, only during the acquisition period)

CG 22 42—Existence or Maintenance of Streets, Roads, Highways, or Bridges (no coverage under the CGL including mobile equipment used for maintenance).

This exclusion commonly is added to the CGL form of a municipality or other governmental subdivision unless coverage is desired.

CG 22 43—Engineers, Architects, or Surveyors Professional Liability (excluded from CGL coverage forms)

CG 22 44—Health or Cosmetic Services (professional exclusion that extends also to medical, food, and embalming services among others)

CG 22 45—Specified Health or Cosmetic Services (exclusion focuses on professional exposures relating to eye care, hearing aid, cosmetic, massage, chiropody, etc. services)

CG 22 46—Rolling Stock (the exclusion applies to rolling stock involved in railroad construction or maintenance except for rolling stock at the job site)

CG 22 47—Saline Substances Contamination (excluded for oil or gas lease operators)

CG 22 48—Insurance and Related Operations (professional exposures excluded)

CG 22 50—Public Utilities—Failure to Supply (exclusion does not apply if failure is caused by sudden accident to production-transmission facilities)

CG 22 51—Law Enforcement Activities.

This endorsement excludes those kinds of claims or lawsuits involving injury or damage that can result from law enforcement activities; but, the endorsement does not exclude liability arising out of the ownership, maintenance, or use of the named insured's premises that are not ordinarily incidental to law enforcement activities.

CG 22 52—Medical Payments Coverage (health care facilities, halfway houses and prisons are not covered for injury to inmates, patients, or prisoners)

CG 22 53—(Self-Service) Laundry and Dry Cleaning Damage (excludes PD to customer's property)

CG 22 54—Logging and Lumbering Operations (excludes vehicle damage during loading or unloading)

CG 22 57—Underground Resources and Equipment (property damage excluded for operations in and around oil wells or gas wells; contrast with CG 22 62)

CG 22 58—Described Hazards (Carnivals, Circuses, and Fairs—excludes BI or PD from mechanical amusement devices and sporting or athletic events)

CG 22 60—Real Estate Operations (premises coverage limited to general offices and some properties listed for sale or rent)

CG 22 62—Underground Resources and Equipment Coverage (adds property damage liability for these properties for operators of oil wells and gas wells, etc.; contrast with CG 22 57)

CG 22 63—Stevedoring Operations (only operations on board vessels are completed operations)

CG 22 64—Pesticide or Herbicide Applicator Coverage (voids the pollution exclusion as to pollutants brought to the job site if all regulatory and licensing mandates are met)

CG 22 65—Optical and Hearing Aid Establishments (covered occurrence can include BI or PD from rendering eye care or hearing aid service; in contrast see exclusion endorsement CG 22 37)

CG 22 66—Misdelivery of Liquid Products Coverage (an expansion of completed operations coverage)

CG 22 67—Corporal Punishment (clarifies that the intentional injury exclusion does not apply to corporal punishment and self-defense type actions)

CG 22 68—Operation of Customer Autos on Particular Premises (for insureds in various types of auto business, the motor vehicle exclusion is waived as to customers' cars on the insured or nearby premises)

CG 22 69—Druggists (covered occurrence can include BI or PD from rendering professional pharmacological service; in contrast see exclusion endorsement CG 22 36)

CG 22 70—Real Estate Property Managed

This endorsement excludes PD liability for property managed and declares the policy excess to other insurance, i.e., the property owner's CGL form, that covers the insured as real estate manager.

CG 22 70—Colleges or Schools Limited Form

Medical payments are eliminated as to any student, professional liability as to the school infirmary is excluded, the motor vehicle exclusion is specifically extended to the transportation of students, and student teachers and board members are included as insureds.

CG 22 72—Colleges or Schools (the same as CG 22 71 above except student med pay is not excluded)

CG 22 73—Oil or Gas Producing Operations (the pollution exclusion is modified so as to be absolute as to pollution from any site where the insured conducts operations)

CG 22 74—Limited Contractual Liability Coverage for Personal and Advertising Injury

CG 22 75—Professional Liability Exclusion—Computer Software (excluding the professional and contractual exposures in conjunction with the insured's software or other EDP products and related products; might be construed to exclude products liability coverage also) CG 22 75 07 98

CG 22 76—Professional Liability Exclusion—Health or Exercise Clubs or Commercially Operated Health or Exercise Facilities (excludes the professional exposure, including treatment and instruction, associated with physical fitness-training programs)

CG 22 77—Professional Liability Exclusion—Computer Data Processing (excluding the E&O and contractual exposures in conjunction with the insured's electronic data processing services)

CG 22 78—Hazardous Material Contractors (eliminates the pollution exclusion at the job site as to operations involving removal, encapsulation, etc., of hazardous material from a building or structure) CG 22 78 07 98

CG 22 79—Exclusion—Contractors—Professional Liability (for use with CGL policies)

CG 22 80—Limited Exclusion—Contractors—Professional Liability (for use with CGL policies)

CG 22 81—Exclusion—Erroneous Delivery or Mixture and Resulting Failure of Seed to Germinate—Seed Merchants (for use with CGL and products policies)

CG 22 87—Exclusion—Adult Day Care Centers.

This endorsement excludes coverage arising out of the rendering of or failure to render medical or nursing service, treatment, advice, or instructions by any insured.

CG 22 88—Professional Liability Exclusion—Electronic Data Processing Services and Computer Consulting or Programming Services

CG 22 90—Professional Liability Exclusion—Spas or Personal Enhancement Facilities

CG 22 91—Exclusion—Telecommunication Equipment or Service Providers Errors and Omissions

CG 22 93—Lawn Care Services Coverage

This endorsement revises the pollution exclusion on the CGL form by stating that paragraph (1) (d) of that exclusion does not apply to the application of herbicides or pesticides by an insured on lawns under the named insured's regular care.

CG 22 94—Exclusion—Damage to Work Performed by Subcontractors on Your Behalf CG 22 94 10 01

This endorsement amends exclusion l. on the CGL form by deleting the subcontractor exception for all exposures. CG 22 95 is the same except it deletes coverage for designated sites or operations rather than on a blanket basis as does CG 22 94.

CG 22 96—Limited Exclusion—Personal and Advertising Injury—Lawyers

This endorsement says that the insurance does not apply to personal and advertising injury arising out of rendering of or failure to render professional services as a lawyer.

CG 22 97—Druggists—Broadened Coverage

This endorsement notes that coverage for bodily injury or property damage arising out of rendering of or failure to render professional health care services as a pharmacist shall be deemed to be caused by an occurrence. However, there is no coverage if the BI or PD is caused by a willful violation of a penal statute or ordinance relating to the sale of pharmaceuticals.

CG 22 98—Exclusion—Internet Service Providers and Internet Access Providers Errors and Omissions CG 22 98 12 04

This endorsement adds an exclusion to both coverages A and B on the CGL form. CG 22 98 states that the insurance does not apply to any injury or damage arising out of an error, defect, or deficiency in any evaluation, consultation, or advice given concerning Internet service or access. Insurance is also excluded for the failure of any insured to adequately provide Internet services or Internet access.

CG 22 99—Professional Liability Exclusion—Web-Site Designers CG 22 99 12 04

This endorsement notes that coverages A and B on the CGL form do not apply to injury or damage arising out of any act, error, or omission with respect to web-site designer or consultant services.

Coverage Amendments

The following amendatory endorsements serve a variety of purposes.

CG 24 01—Non-Binding Arbitration (gives insurance company and insured the right to submit to non-binding arbitration)

CG 24 02 Binding Arbitration (same as above except the decision of the arbitrator is binding on all parties)

CG 24 03—Waiver of Charitable Immunity (insurance company will waive charitable immunity as a defense unless insured requests otherwise in writing)

CG 24 04—Waiver of Transfer of Rights of Recovery Against Others to Us (the insurance company will not seek to recover from owner or contractor for damages paid for accidents arising out of the insured's work under contract to these parties)

CG 24 05—Financial Institutions Reporting Provision and Limitation to Fiduciary or Representative Interest (calls for a report every sixty days to the insurer detailing the acquisition and termination of fiduciary properties; and for immediate notice whenever the insured converts the fiduciary interest to active management of any commercial enterprise) CG 24 05 12 04

CG 24 07—Products/Completed Operations Hazard Redefined (the exposure is triggered when the product is relinquished to others instead of when off the insured premises; restaurants use the endorsement, for instance) CG 24 07 01 96

CG 24 08—Liquor Liability (deletes the liquor liability exclusion from the CGL form)

CG 24 09—Governmental Subdivisions (any officer or board member is an insured; and that part of the mobile equipment definition that includes motor vehicles maintained for use on the insured's premises is rescinded as to motor vehicles maintained for use on the streets and highways of the governmental body)

CG 24 11—Fiduciaries—Fiduciary Interest (seven specific amendments to the CGL form when the insured is in the position of fiduciary) CG 24 11 12 04

CG 24 12—Boats (BI and PD coverage may be extended to scheduled watercraft; includes permissive users of owned watercraft as additional insureds)

CG 24 14—Waiver of Governmental Immunity (the insurance company will waive governmental immunity as a defense unless the insured requests in writing that it not do so)

CG 24 15—Limited Pollution Liability Extension Endorsement (with this form, the insurer may offer limited protection, subject to an aggregate limit, for on-premises pollution exposures, without resorting to a separate pollution liability policy) CG 24 15 10 01

CG 24 17—Contractual Liability—Railroads (with respect to operations performed for or affecting scheduled railroad, definition of insured contract is changed to provide contractual liability coverage for liability that the contractor assumes under a contract, holding the railroad harmless) CG 24 17 10 01

CG 24 18—Seed Merchants—Coverage for Erroneous Delivery or Mixture and Resulting Failure of Seed to Germinate (for use with CGL coverage part)

CG 24 22—Amendment of Coverage Territory—Worldwide Coverage CG 24 22 10 01

This endorsement broadens the coverage territory definition under the CGL form to include anywhere in the world, with the exception of any country or jurisdiction that is subject to trade or other economic sanction or embargo by the United States. G 24 23amends the coverage territory definition to include additional countries that are scheduled on the endorsement. CG 24 24 amends the definition so that coverage territory means anywhere in the world except those countries specified in the schedule of the endorsement, or any country subject to trade or other economic sanctions by the United States.

Amendment of Limits

Four endorsements can be used to amend the limits of insurance.

CG 25 01—Amendment of Limits of Insurance—Designated Project or Premises CG 25 01 07 98

If for any reason an insured wishes to have certain limits be lower [med pay, for example] at one site than at others, this endorsement accomplishes that; the limit(s) scheduled on the endorsement are not additional limits but are included in the limits described in the declarations.

CG 25 02—Amendment of Limits of Insurance (changes the limits shown on the declarations page)

CG 25 03—Designated Construction Project(s)—General Aggregate Limit (the general aggregate expressed in the policy is applied separately to each project away from the insured's premises) CG 25 03 03 97

CG 25 04—Designated Location(s)—General Aggregate Limit (the general aggregate expressed in the policy is applied separately to each of the named insured's locations that are owned or rented) CG 25 04 03 97
