The insurance company argued that the defendants were negligent and are liable for the $170,000 policy paid to the insured for the damages caused by a fire, the complaint said.
The proposed class encompasses Hartford Insurance policyholders in New Jersey and those insured by Twin City in Missouri who filed claims within certain dates.
The complaint alleges that the defendant's actions with respect to the unauthorized use of the Travelers Marks have damaged and irreparably injured Travelers and its associated entities.
There are strong opinions about litigation funding with some believing it promotes frivolous lawsuits while others say it aids plaintiffs who can't afford to bring suit against a defendant.
In 2012, a trial court found that Nationwide had to indemnify defendant Jeffrey S. Pasiak, according to the opinion, but the Appellate Court reversed the judgment.
