The New Mexico Office of Superintendent of Insurance published a bulletin informing insurers of a revision to the Insurance Code’s Unfair Claims Practices law, effective June 20, 2025.

Property or homeowners' insurers and producers are prohibited from treating an applicant’s or insured’s inquiry about damage or loss as a claim when the policy does not cover the elements of the inquiry. Doing so can constitute an unfair claims practice.

The bulletin can be found here.
