Summary: Category 25 of ISO crime forms consists of forty-nine various endorsements that change certain crime policy provisions. The endorsements have been developed to modify provisions in the crime and fidelity forms and policies. Most of the endorsements were revised in June 2022, a few were revised in 2010 or earlier, and a new endorsement was added in May 2023. The endorsements are presented in numerical order. In many of the updates minor formatting or editorial changes have been made, while others have more significant changes. This endorsement amends the definition of "employee" to exclude any person or class of person named in the Schedule of the endorsement. This precludes the designated persons from coverage that is afforded to employees in the policy. The endorsement may be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
This endorsement adds designated agents of the insured as "employees". It also allows the insured to choose a limit of insurance that applies to each agent in the Schedule of the endorsement. This limit of insurance is part of, not in addition to, the limit shown on the declarations page. Any agent and the partners, members, officers, and employees of that agent are considered to be one "employee" under this endorsement. The insurer will pay for loss caused by an "employee", but not for faithful performance of their duties—even if the policy contains an endorsement providing "faithful performance" coverage for other employees. The endorsement may be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, the Government Crime Policy, and the Government Fidelity and Forgery Policy.
CR 25 03 provides a schedule to add, as "employees", designated persons who are partners of the insured. The definition of "employee" is modified to include any natural person who is a partner in a partnership that is an insured and who is listed in the schedule. The basic crime policy excludes theft by any of the insured's partners. This endorsement adds theft coverage for designated partners. No coverage is provided until the amount of loss exceeds the sum of the following:
- Any amounts the named insured owes to the partner on the date that loss was discovered
- The value of the partner's interest in the partnership, determined by the closing of that partnership's books on the date that was loss was discovered
- The deductible
The insurer will then pay the amount of loss, up to the Limit of Insurance applicable to the Employee Theft Insuring Agreement. This form can be attached to the Commercial Crime Coverage Form, the Commercial Crime Policy, and the Commercial Fidelity and Forgery Policy.
In this endorsement a schedule is provided to add, as "employees", designated persons who are members of an insured limited liability company (LLC). As with partners, the acts of members are also not covered by the basic crime policy. This endorsement makes scheduled parties "employees" by definition, providing coverage for them as such. There is no coverage unless the amount of loss exceeds the sum of any amounts owed by a "member" as of the discovery date of the loss, the value of that "member's" membership interest in the LLC under this policy, as determined by the closing of the LLC's books on the date of the discovery of the loss and any deductible that applies. Then the amount of loss over that sum, up to the policy limits, will be provided. This form can be attached to the Commercial Crime Coverage Form, the Commercial Crime Policy, and the Commercial Fidelity and Forgery Policy.
CR 25 06 allows the chairperson, or a member of any committee named in the Schedule to be added to the policy as "employees". Many businesses have committees that are chaired by non-employees, or that have non-employees as members. This endorsement extends coverage to these individuals when acting in their capacity as either a committee chairperson or member. This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, The Government Crime Policy and the Government Fidelity and Forgery Policy.
This endorsement provides a Schedule to include non-compensated officers as an "employee". This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, The Government Crime Policy and the Government Fidelity and Forgery Policy.
Volunteer workers, or any non-compensated natural person, can be added as "employees" using this endorsement. Volunteers acting as fund solicitors during fundraising campaigns are included. However, fund solicitors while they are performing duties usual to an employee are excluded. This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, The Government Crime Policy and the Government Fidelity and Forgery Policy.
This endorsement is similar to the one above, CR 25 09, but does not include coverage for fund solicitors in any capacity. This endorsement can be used with the Commercial Crime Coverage Form, the Commercial Crime Policy, the Commercial Fidelity and Forgery Policy, the Government Crime Coverage Form, The Government Crime Policy and the Government Fidelity and Forgery Policy.
