An Illinois jury has rendered a defense verdict in a personal injury case in which the defense pointed to gaps in the plaintiff's medical treatment.
Facts and Allegations
Marcin Jarog alleged that his car was struck by a car driven by Shane Glenn Ambler on May 13, 2015 and that his shoulder was injured.
Mr. Jarog sued Mr. Ambler, alleging negligence.
Mr. Ambler maintained that there was no proof of negligence and that there was a gap between the date of the accident and when Mr. Jarog first sought medical attention and another gap between September 2015 and August 2016. The defense further questioned the severity of Mr. Jarog's injury since he did not tell his physicians about allegedly hitting his shoulder in the accident until August 2016.
