|“Just as the mediation process empowers the parties to determinethe outcome of a dispute, a skilled mediator and counsel willrecognize, during mediation, when mindful recognition of harmsustained by one of the parties (typically the claimant), or actualapology will advance the resolution process” writes Day, a FloridaSupreme Court certified, County, Circuit, Family, and Appellatemediator and a certified civil case mediator for the FederalDistrict Court for the Middle District of Florida.
|“The manner of the communication of the apology by the party orof the recognition that suffering has occurred is significant,” hecontinues. “In a workers' compensation mediation,acknowledgement by the carrier that a claimant has been frustratedby an interruption (or termination) in the providing of benefitsduring the dispute resolution process may lead to the ultimateresolution of the case.”
