A $3M southeastern soil remediation/scrap metal recycler specializes in remediating and transporting contaminated soil, treating/burning the contaminants, and selling the treated soil to construction companies for reuse. They also remove underground storage tanks and recycle the steel once it is properly remediated and treated.

The insured currently has a package General Liability/Contractors Pollution policy, but the Contractors Pollution is limited to jobsite coverage only. Additionally, hauling the soil back to their owned processing center is not covered, and their General Liability policy does not include Products Pollution coverage for the reselling/reuse of the soil intended as infill dirt for other projects. By carefully reviewing the current insurance program and identifying the areas still needing coverage, we have helped the agent rework the account so that the client now has sufficient protection in the event of a claim when handling, transporting, storing, or distributing the soil. The new policy(s) will include General Liability/Contractors Pollution Liability, Transportation Pollution Liability, Products Pollution, and Site Pollution. In addition, the insured will secure a $4 million Excess policy and Auto coverage with Broadened Pollution endorsement and MCS90.

The premium breakdown totals:

  • $15k in premium with a $1M limit for the General Liability, Products Pollution, Contractors Pollution Liability, and Site Pollution. 
  • $17k in premium for a $4M Excess policy over the primary. 
  • $36k in premium for the Auto coverage, which includes Broadened Pollution and MCS90.

This is a great example of why is it important to examine your clients' policies to make sure ALL of their operations are covered. The coverage written in prior years may not have been carried out correctly, or the extent of the insured's daily activities may not have been fully explored or understood. Reviewing an existing policy may bring to light some gaps in coverage—and provide an opportunity for the agent to add additional lines to a policy.
