Editor's Note: Business premises require regular maintenance and inspections. In this week's question, the insured experienced insufficient airflow for several years when a regular inspection would have caught the problem much earlier. Will there be coverage for this insured's loss?
Question: My client has a Building and Business Personal Property policy (CP 00 10) and Special Form Cause of Loss (CP 10 30).
There is a flex duct line laid in the attic. The duct has not been putting out good airflow for the past three to four years. During a recent construction project, a contractor noticed that the flex duct had been stepped on, causing a restriction in airflow to parts of the building. Would you please let me know if there is a potential for coverage here and under what circumstances?

Analysis: Every property owner, personal or business, has a responsibility to inspect their property for maintenance issues that need attention regularly and take care of such issues expediently. Typically, putting off maintenance only leads to a much larger problem, evidenced in the recent collapse of a condominium building in Surfside, Florida.
