Question: The insured was hired by a general contractor to install panels in a gymnasium. The general contractor is alleging the panels were installed improperly, resulting in peeling and buckling, and the need for them to be replaced.

A claim was submitted under the insured's general liability policy, but coverage was been denied per the policy's "property damage" definition in endorsement CGD 90 33 04 09. The insured's work only included the installation of the panels. Would you please provide a coverage opinion as to if there would be any coverage for resulting damages, i.e. the cost of the new replacement panels?

Analysis: The commercial general liability policy provides coverage for an insured's liability for actions that cause physical injury or property damage. When damage arises from work the insured has performed as part of his duties, that is generally excluded. However, many exclusions have exceptions that offer coverage or provide coverage for an ensuing loss.
