New York Attorney General Andrew Cuomo has decided to withdraw his appeal of a judge's July decision to throw out the convictions of two Marsh & McLennan executives, according to court documents.
New York Supreme Court Judge James A. Yates in July threw out the 2008 convictions of William Gilman and Edward McNenney, both managing directors at Marsh, stating that prosecutors failed to disclose evidence that would have impacted the outcome of the case. .
Mr. Gilman and Mr. McNenney were sentenced in 2008 to 90 days in jail and five years probation after an 11-month trial.
Mr. Cuomo's office and Robert J. Cleary, attorney for Mr. Gilman, did not immediately respond to requests for comment.
