California Department of Insurance (CDI) has begun legal proceedings against The Hartford Insurance Group, alleging that the company charged illegal fees. According to the CDI, the complaint argues that The Hartford allowed one of its agents, Superior Access Insurance Services, to charge and collect fees not approved by the CDI. The CDI must approve all property and casualty insurance rates and charges.
CDI maintains that Superior Access, with The Hartford's knowledge, added unapproved fees — around $100 per policy — to the premium The Hartford was allowed to charge by law. Thousands of policyholders possibly paid the illegal fees on workers' compensation and business owner package policies.
Because Superior Access is The Hartford's agent, California law treats the fees as if The Hartford received them, even though it did not. CDI is investigating several general agents and insurance companies for similar infractions.
